1. Acceptance of Terms
By using the Perch app and its related services, you agree to these Terms & Conditions.
2. Overview
Perch is a technology platform that connects customers with food truck vendors ("Vendors"). Perch does not own, operate, or manage any food trucks. All purchases are made directly between the customer and the Vendor.
3. Use of the Service
Eligibility: You must be at least 13 years old to use Perch.
Account Responsibility: You are responsible for maintaining the confidentiality of your login information. Perch reserves the right to suspend or terminate accounts that violate these terms.
4. Orders and Payments
Placing Orders: Once you place an order through Perch, it is final and non-refundable unless the Vendor approves a cancellation. Vendors, not Perch, are responsible for order fulfillment and customer service.
Pricing: Prices are set by individual food truck vendors. Vendors must honor the prices displayed on the platform at the time of purchase.
Refunds and Cancellations: Any refund disputes must be resolved between you and the Vendor. Perch provides tools for Vendors to issue refunds but does not handle refunds directly.
Payment Processing: Payments are processed through Perch’s secure third-party payment system. You agree to comply with their terms. Perch only facilitates payments and is not responsible for any errors, disputes, or failed transactions.
5. Customer Responsibilities
By using Perch, you agree to provide accurate payment information, pick up your order at the designated time and location, and contact the Vendor directly for any issues with your order.
6. Prohibited Conduct
Customers may not misuse the platform for fraudulent purposes, attempt to charge back valid transactions, harass or abuse Vendors or Perch staff, or violate any laws while using Perch.
7. Platform Availability
Perch does not guarantee uninterrupted service and may update or discontinue parts of the platform without prior notice.
8. Limitation of Liability
Perch is not liable for food quality, safety, or compliance with regulations. Any issues arising from transactions between customers and Vendors must be resolved between the two parties. Perch is not responsible for delays, missed orders, or financial losses. Your sole remedy for dissatisfaction with Perch is to stop using the platform.
9. Intellectual Property
All trademarks, branding, and platform technology remain the property of Perch. You may not use Perch branding without written permission.
10. Termination
We reserve the right to suspend or terminate your account if you violate these terms or engage in fraudulent activity. You may stop using Perch at any time.
11. Governing Law
These Terms shall be governed by the laws of Pennsylvania. Any disputes shall be resolved through binding arbitration in Pennsylvania, under Delaware law.
12. Privacy Policy
By using Perch, you agree to our Privacy Policy, which details how we collect and store your data.
13. Changes to Terms
We may modify these Terms at any time. The latest version will always be available on our website.
